Defendant Oliver Cathey was charged with the crime of rape in violation of sec. 944.01, Stats., and entered a plea of not guilty to the information. A jury was waived and the case was tried to the court. The court, on July 16, 1965, adJudged him guilty of the offense charged. On October 29, 1965, defendant was sentenced to an indeterminate term of not more than fifteen years in the state prison. Thereafter defendant moved the circuit court for a judgment of acquittal notwithstanding the courts "verdict," or in the alternative for a new trial. After a hearing held on this motion, at which the state adduced testimony in opposition to the motion, the circuit court, by order made February 25, 1966, denied the motion. Defendant has appealed both from this order and the prior judgment of conviction. The facts will be stated in the opinion.
